By viewing and using our website and availing of our products and services, you are agreeing to be bound by all of these terms, conditions and notices, without modification. If you do not agree with our terms, conditions and notices, then you must not use our website or our services and products.
Our website is made available for your personal, non-commercial use only, except where otherwise authorized by us. It is your responsibility, bearing in mind the global nature of the internet, to comply with all relevant laws which may apply to your use of our website and to the material you post, including but not limited to laws relating to acceptable content, online conduct and the export of data. Failure to comply with all applicable laws or our Terms of Use may result in deletion of posts, suspension of posting privileges and/or banning. When using our website, you will not commit or encourage a criminal offence or act contrary to the acceptable community standards generally.

You are responsible for all activities occurring under your username and for keeping your password secure. We strongly recommend you do not reuse a password which you also use elsewhere. We reserve the right to log off or deactivate accounts that are inactive for an extended period of time. We may at our absolute discretion refuse you access to our website or our services, delete posts by you or suspend/terminate your account without prior notice for any reason and you shall not be entitled to any compensation in respect of this.

Irish Heritage News may provide users an opportunity to transmit or post text, videos, photographs, images, sound files and/or other content to the website and may provide for the hosting, sharing and/or publishing of such content. You understand that all user content is the sole responsibility of the person who transmits or posts that content. This means that you, and not Irish Heritage News, are entirely and solely responsible for all content that you transmit or post and for the consequences of publishing such content. Irish Heritage News is under no obligation to monitor the user content areas.
We are committed to providing an open forum for discussion and debate on heritage items. Each of our articles has a comments section available to our users to facilitate such discussion and debate. We expect you to act responsibly in posting comments. You are liable for the contents of any comments you post and shall indemnify in accordance with our Terms of Use. We shall not be responsible or liable for any comments posted by any user and we do not endorse the contents of users’ posts or warrant the accuracy, truthfulness, legality or reliability of users’ posts. Any views, comments or content expressed in the user posts are not necessarily the views of Irish Heritage News, any entity associated with us or any of our writers or editors, and we do not necessarily endorse, support, sanction or agree any user content. We expressly disclaim any and all liability in connection with any user content.
You are responsible for making sure that you have all rights to what you post. By posting any material on our website you represent and warrant that you own the material posted by you; the posting of the material does not violate the privacy rights, publicity rights, intellectual property rights, contract rights or any other rights of any person. Due to the real-time nature of our website and our limited resources, we cannot and are not required to review the contents of posted comments, nor do we confirm the validity of information submitted. We do not actively monitor user comments and we are not responsible for and give no warranty or make any representation in relation to any user comments. If you deem any comments offensive, objectionable or defamatory, please bring these to our attention by identifying the specific material that you consider objectionable. You can do this by emailing us directly at info@irishheritagenews.ie or using the contact form provided on the website here. You will be asked to give your reasons for wanting the comment removed. We will attempt to respond to your concerns in a reasonable timeframe.
Irish Heritage News shall have the right, but not the obligation, to refuse, delete, move, remove or edit any user content. Whilst we do not monitor user comments/posts, we reserve the right to refuse to display material that comes to our attention via a complaint or otherwise. You will not necessarily be notified when comments are removed. Users who repeatedly flout our Terms of Use will be barred from joining discussions on our website. We will not enter into any correspondence with or about users who have been blacklisted. We reserve the right to immediately ban a user if there has been a serious breach of our Terms of Use. A determination of what conduct is considered in violation of our Terms is up to the management of Irish Heritage News and all decisions in relation to these matters are carried out at our sole discretion.
If you post a comment by logging-in using a Twitter or Facebook account you warrant and represent that you are the owner of the social media account and that you are the person identifiable by that account.
We reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any comment or content posted by you.

(iii) Capacity
Our website is not directed at children younger than 16 and therefore children under the age of 16 are not permitted to view our website. We cannot guarantee that all content on our site will be suitable for minors.
You are only permitted to post comments if you are aged 18 or over. By posting a comment on our website you warrant and represent that you are over the age of 18. We cannot and are not required to verify the age of users of our website.

In order to process your order and payment method, Irish Heritage News may provide information regarding your order, payment method or user account to a third-party processor. Irish Heritage News makes no representations about any third parties’ privacy practices. Where a contract is made with a third party, Irish Heritage News is not acting as either agent or principal and the contract is made between yourself and that third party.
Shipping methods and delivery times cannot be guaranteed. Dispatch times may vary according to availability. We are not responsible for any delay in delivery occurring due to postal delays, force majeure or any other reasons beyond our control, including fire, accident, acts of God, strike, carrier delays, power or system failure.
(i) Agreement
By making a contribution, a contributor agrees and acknowledges that:
The contribution is provided to Irish Heritage News as an irrevocable contribution, subject to any exercise of the contributor’s right to receive a refund and Irish Heritage News’s right to return any contribution at its discretion.
The contribution is made subject to these Terms and Conditions, which shall constitute a legally binding agreement between the contributor and Irish Heritage News (the “Agreement”), entered into by each party in consideration of the other’s obligations under these Terms and Conditions.
(ii) Conditions
Contributions will be accepted from individuals as well as any other legal entities.
Contributors who are individuals must be aged 18 or over.
Acceptance of any contribution is at the discretion of Irish Heritage News.
(iii) Administration of Contributions
Each contribution will be identifiable by a unique payment identification number and so are individually refundable, and will be accounted for separately by Irish Heritage News.
From the moment the contribution is processed, Irish Heritage News will be legally and beneficially entitled to the full amount of the contribution and the contributor has no entitlement to the return of a contribution in any circumstances other than as specified in these Terms and Conditions.
The contributor shall receive no benefit in return for any contribution and shall have no rights to influence the editorial policy or output of Irish Heritage News.
Irish Heritage News will not compensate, whether through commissions, finders’ fees or other means, any third party for directing a contribution to Irish Heritage News.
Contributions to Irish Heritage News are not charitable donations under law and, as far as Irish Heritage News is aware, contributors shall not be entitled to any tax relief in respect of their contributions.
(iv) Refunds and Cancellations of Contributions
Irish Heritage News reserves the right to refuse and return any contribution in its absolute discretion, including without limitation where it believes that accepting the contribution would conflict with the mission, values or interests of Irish Heritage News, and/or where, having regard to the source of the contribution or intentions of the contributor, Irish Heritage News considers that to accept the contribution could damage the independence or reputation of Irish Heritage News or adversely affect the relationship of Irish Heritage News with other contributors.
Contributors shall be entitled to receive a refund of their contribution for up to 14 days after receipt of payment by notifying Irish Heritage News by email at info@irishheritagenews.ie. Any requests for a refund of a contribution received by Irish Heritage News following expiry of the 14-day period will be ineligible.
Any refused and/or returned contributions shall be repaid into the account from which the contribution was made.
(v) Transparency of Contributions
Irish Heritage News reserves the right to:
Request the full name and contact details of the contributor;
Request from the contributor any other information that it considers to be necessary or desirable to determine the provenance of the contribution;
Undertake any further investigations it deems fit to determine the provenance of the contribution.
If the contributor refuses to provide any information as outlined above, Irish Heritage News may refuse and return the contribution to the contributor at its discretion.
(vi) Confidentiality and Publicity
Contributors shall not be entitled to publicise their contribution or otherwise market themselves or any connected person or business in connection with their contribution, except with the prior written consent of Irish Heritage News and then only if the contributor complies with any relevant policies, procedures or requirements of Irish Heritage News.
(vii) Data Protection and Privacy
Information about how we handle your personal data is set out separately in the Irish Heritage News Privacy Policy.
(viii) Exclusion of Liability
Neither Irish Heritage News nor any affiliated person, owner, director, employee or officer shall be liable for any loss suffered by any donor or other person arising out of or in connection with a contribution, whether direct or indirect, including loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise.
(ix) Miscellaneous
A failure of Irish Heritage News to assert a right or provision under these Terms and Conditions shall not constitute a waiver of that right or provision.
This Agreement constitutes the entire agreement between the contributor and Irish Heritage News in respect of any contributions made by the contributor.

You acknowledge that your use of our website is at your own discretion and risk and you agree to waive to the fullest extent permissible by law any right to bring any claim or action against us, contractors, contributors, third-party advertisers, technology providers or other partners, for any loss, damage, costs or injury arising from such use.
We do not give any warranty or make any representation as to the accuracy or completeness of the information contained on our website or in printed material. We will strive to have any inaccuracies amended if possible but we make no commitment to update the information. We disclaim all liability and responsibility arising from any reliance placed on our content by any user or by anyone who may be informed of any of its contents.
We do not warrant that the website is free from infection by viruses or anything else that has contaminating or disruptive properties.

Under no conditions and in no event shall we be liable for any direct or indirect, incidental, consequential, special or exemplary damages or loss howsoever arising, or for any loss of data, profit, revenue, reputation, goodwill, other intangibles or business howsoever caused even if that loss or damage was foreseeable by us or the possibility of it was brought to our attention.
Irish Heritage News may at any time terminate or suspend any part of our services without notice to you. You acknowledge and agree that we, at our sole discretion, may terminate your use of the website without prior notice, and remove and discard any user content, for any reason, with or without prior notice, including, without limitation, if we believe that you have violated or acted inconsistently with these Terms of Use or our Privacy Policy. You acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account. In the event that this should occur, you agree not to re-register on the website. You acknowledge that we reserve the right to take action – legal, technical or otherwise – to block or deny your ability to register or submit user content. You understand that we may exercise this right in our sole discretion. You agree that we shall not be liable to you or any third party for termination of your access to the website.
