Please read the Terms of Use (terms and conditions) below carefully as they constitute a binding legal agreement between you and us in relation to your use of our website, services and products. The terms “we”, “us”, “our”, “the website” and “IHN” below are references to Irish Heritage News; the terms “you”, “your” and “user” refer to the user or viewer of the Irish Heritage News website; the terms “submitter” and “contributor” refers to someone who submits material or content to be reproduced on the Irish Heritage News website, our social media accounts or in our printed/digital material/products.

1. Introduction

Access to and use of this website and the services and products available through this website are subject to the following terms, conditions and notices. By viewing and using our website and availing of our products and services, you are agreeing to be bound by all of these terms, conditions and notices, without modification. If you do not agree with our terms, conditions and notices, then you must not use our website or our services and products.

2. Your Use of Our Website

Our website is made available for your personal, non-commercial use only, except where otherwise authorized by us. It is your responsibility, bearing in mind the global nature of the internet, to comply with all relevant laws which may apply to your use of our website and to the material you post, including but not limited to laws relating to acceptable content, online conduct and the export of data. Failure to comply with all applicable laws or our Terms of Use may result in deletion of posts, suspension of posting privileges and/or banning. When using our website, you will not commit or encourage a criminal offence or act contrary to the acceptable community standards generally.

If you register an account with us then as part of the registration process you may be asked to select a username and password. You are responsible for all activities occurring under your username and for keeping your password secure. We strongly recommend you do not reuse a password which you also use elsewhere. You may not select a username that misrepresents your relationship with any website, business or any other party or impersonates someone else; contains any profanity; is vulgar or offensive; promotes an illegal activity; or violates any trademark or other proprietary right. You must notify us immediately if you suspect any unauthorized use of your account. We shall not be liable for any loss that you may incur as a result of someone else using or accessing your password or account, either with or without your knowledge.

We reserve the right to log off or deactivate accounts that are inactive for an extended period of time. We may at our absolute discretion refuse you access to our website or our services, delete posts by you or suspend/terminate your account without prior notice for any reason and you shall not be entitled to any compensation in respect of this.

Irish Heritage News may provide users an opportunity to transmit or post text, videos, photographs, images, sound files and/or other content to the website and may provide for the hosting, sharing and/or publishing of such content. You understand that all user content is the sole responsibility of the person who transmits or posts that content. This means that you, and not Irish Heritage News, are entirely and solely responsible for all content that you transmit or post and for the consequences of publishing such content. Irish Heritage News is under no obligation to monitor the user content areas.

We are committed to providing an open forum for discussion and debate on heritage items. Each of our articles has a comments section available to our users to facilitate such discussion and debate. We expect you to act responsibly in posting comments. You are liable for the contents of any comments you post and shall indemnify in accordance with our Terms of Use. We shall not be responsible or liable for any comments posted by any user and we do not endorse the contents of users’ posts or warrant the accuracy, truthfulness, legality or reliability of users’ posts. Any views, comments or content expressed in the user posts are not necessarily the views of Irish Heritage News, any entity associated with us or any of our writers or editors, and we do not necessarily endorse, support, sanction or agree any user content. We expressly disclaim any and all liability in connection with any user content.

You are responsible for making sure that you have all rights to what you post. By posting any material on our website you represent and warrant that you own the material posted by you; the posting of the material does not violate the privacy rights, publicity rights, intellectual property rights, contract rights or any other rights of any person. You agree to pay for all royalties, fees or any other monies owing any person by reason of any material posted by you.

You agree, through use of our website, not to post any material which: is unlawful and violates criminal law; promotes or encourages illegal activity; is defamatory, libellous, invasive of privacy, abusive, harassing, threatening, profane, violent, sexually explicit, vulgar, pornographic, profane, indecent, false, inaccurate, deceptive or which violates the rights of others or is harmful to minors in any way; impersonates another person; includes any person’s full name or personal or identifying information without that person’s authorization; may prejudice ongoing civil or criminal proceedings, violate the sub judice rule or may otherwise amount to a contempt of court; infringes the copyright, patent, trademark, trade secret, patent, database right, right of privacy or publicity or other proprietary or intellectual property right of any person unless you are the owner of such rights or have permission from their rightful owner to post the material; includes any spam, unauthorized advertising, solicitations of business or any other form of commercial publicity; imposes an unreasonable or disproportionately large load on our servers, bandwidth or infrastructure; falsely claims to be sponsored or endorsed by us; or contains any virus, bots, worms, trojan horses or similar harmful and/or disruptive material.

Due to the real-time nature of our website and our limited resources, we cannot and are not required to review the contents of posted comments, nor do we confirm the validity of information submitted. We do not actively monitor user comments and we are not responsible for and give no warranty or make any representation in relation to any user comments. If you deem any comments offensive, objectionable or defamatory, please bring these to our attention by identifying the specific material that you consider objectionable. You can do this by emailing us directly at info@irishheritagenews.ie or using the contact form provided on the website here. You will be asked to give your reasons for wanting the comment removed. We will attempt to respond to your concerns in a reasonable timeframe.

Irish Heritage News shall have the right, but not the obligation, to refuse, delete, move, remove or edit any user content. Whilst we do not monitor user comments/posts, we reserve the right to refuse to display material that comes to our attention via a complaint or otherwise. You will not necessarily be notified when comments are removed. Users who repeatedly flout our Terms of Use will be barred from joining discussions on our website. We will not enter into any correspondence with or about users who have been blacklisted. We reserve the right to immediately ban a user if there has been a serious breach of our Terms of Use. A determination of what conduct is considered in violation of our Terms is up to the management of Irish Heritage News and all decisions in relation to these matters are carried out at our sole discretion.

If you post a comment by logging-in using a Twitter or Facebook account you warrant and represent that you are the owner of the social media account and that you are the person identifiable by that account.

We reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any comment or content posted by you.

By transmitting or posting user content , you grant Irish Heritage News the perpetual non-exclusive right to use, reproduce, edit, remove, modify, publish, transmit, display, distribute, have distributed, promote, perform and prepare derivative works of, all or any portion of such user content in any form, in any medium now existing or hereinafter invented for any purpose, including commercial uses, including without limitation, in connection with the website, in connection with promoting and redistributing part or all of the website (and derivative works thereof) without additional notice, approval, consent, compensation or attribution.

(iii) Capacity

Our website is not directed at children younger than 16 and therefore children under the age of 16 are not permitted to view our website. We cannot guarantee that all content on our site will be suitable for minors.

You are only permitted to post comments if you are aged 18 or over. By posting a comment on our website you warrant and represent that you are over the age of 18. We cannot and are not required to verify the age of users of our website.

4. Intellectual Property, Software, Content and Trademarks

All intellectual property rights in our website design, text, graphics, content, the selection and arrangement thereof and all software is vest in Irish Heritage News, its advertisers or content suppliers, unless otherwise indicated. You agree not to index, screenscrape, reformat or frame any portion of our website.

In no event are you permitted to publish, distribute, display, transmit, modify, adapt, translate, reverse engineer, decompile, disassemble, create derivative works or otherwise reproduce in any format any portion of our website or software, any of the content on our website or other works, including printed or digital material. You are prohibited from using any such content in connection with any business or commercial enterprise including, without limitation, any media business or enterprise. You may not sell or participate in any sale of, or exploit in any way, in whole or in part, any material made available on our website without our written permission.

Except where expressly stated to the contrary all persons, products, services and locations featuring on the Irish Heritage News website are in no way connected, associated, linked or affiliated to Irish Heritage News. Any trademarks/names/brands as may be featured on the Irish Heritage News website are owned by the respective trademark owners and Irish Heritage News claims no connection, association or affiliation with them. Where a trademark (brand name) is referred to, it is in no way an assertion or claim that such products are endorsed by or connected, associated, linked or affiliated to Irish Heritage News.

Third party sites linked via our website are not covered by these Terms of Use.  Your use of such linked sites will be subject to the terms of service contained within each such site.

We permit third parties to link to our website so long as the link is not in any way misleading and does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services. By linking to our website, you hereby authorize Irish Heritage News to link to any website owned or controlled by you.

All information and material submitted by you to Irish Heritage News or that you publish on any public area of the Irish Heritage News website shall be provided by the submitter and is subject to our Terms of Use. If you contact us with feedback, suggestions, ideas, comments and advice about how to improve our website, content, services and products, you are agreeing that your offerings shall become our property unless otherwise agreed by us. If you do not want to grant us property of your offerings, please do not make submissions to us.

Irish Heritage News have the right in its absolute discretion at any time and without notice to amend, remove or vary any of the content supplied in connection with its services or which appears on any page of the Irish Heritage News website.

10. Products and Services

You may be able to use the website to purchase products, goods or services. By making a request/order you are offering to purchase a product which we will accept to sell to you on the following Terms of Use. Irish Heritage News is entitled to refuse any request made by you. All requests are subject to availability and confirmation of the order price by us.

When making a request you undertake that all details you provide to us requesting products or services are true and accurate, that you are an authorized user of the credit or debit card (or other payment method) used to make your request and that there are sufficient funds to cover the cost of the products or services. It is your responsibility to inform us of any changes to these details as soon as possible.

By making a purchase, you authorize Irish Heritage News to bill your payment method. Unless expressly stated otherwise at time of purchase, all purchases are final and non-refundable. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

In order to process your order and payment method, Irish Heritage News may provide information regarding your order, payment method or user account to a third-party processor. Irish Heritage News makes no representations about any third parties’ privacy practices. Where a contract is made with a third party, Irish Heritage News is not acting as either agent or principal and the contract is made between yourself and that third party.

Shipping methods and delivery times cannot be guaranteed. Dispatch times may vary according to availability. We are not responsible for any delay in delivery occurring due to postal delays, force majeure or any other reasons beyond our control, including fire, accident, acts of God, strike, carrier delays, power or system failure.

11. Financial Contribution Terms

(i) Agreement

By making a contribution, a contributor agrees and acknowledges that:

The contribution is provided to Irish Heritage News as an irrevocable contribution, subject to any exercise of the contributor’s right to receive a refund and Irish Heritage News’s right to return any contribution at its discretion.

The contribution is made subject to these Terms and Conditions, which shall constitute a legally binding agreement between the contributor and Irish Heritage News (the “Agreement”), entered into by each party in consideration of the other’s obligations under these Terms and Conditions.

(ii) Conditions

Contributions will be accepted from individuals as well as any other legal entities.

Contributors who are individuals must be aged 18 or over.

Acceptance of any contribution is at the discretion of Irish Heritage News.

(iii) Administration of Contributions

Each contribution will be identifiable by a unique payment identification number and so are individually refundable, and will be accounted for separately by Irish Heritage News.

From the moment the contribution is processed, Irish Heritage News will be legally and beneficially entitled to the full amount of the contribution and the contributor has no entitlement to the return of a contribution in any circumstances other than as specified in these Terms and Conditions.

The contributor shall receive no benefit in return for any contribution and shall have no rights to influence the editorial policy or output of Irish Heritage News.

Irish Heritage News will not compensate, whether through commissions, finders’ fees or other means, any third party for directing a contribution to Irish Heritage News.

Contributions to Irish Heritage News are not charitable donations under law and, as far as Irish Heritage News is aware, contributors shall not be entitled to any tax relief in respect of their contributions.

(iv) Refunds and Cancellations of Contributions

Irish Heritage News reserves the right to refuse and return any contribution in its absolute discretion, including without limitation where it believes that accepting the contribution would conflict with the mission, values or interests of Irish Heritage News, and/or where, having regard to the source of the contribution or intentions of the contributor, Irish Heritage News considers that to accept the contribution could damage the independence or reputation of Irish Heritage News or adversely affect the relationship of Irish Heritage News with other contributors.

Contributors shall be entitled to receive a refund of their contribution for up to 14 days after receipt of payment by notifying Irish Heritage News by email at info@irishheritagenews.ie. Any requests for a refund of a contribution received by Irish Heritage News following expiry of the 14-day period will be ineligible.

Any refused and/or returned contributions shall be repaid into the account from which the contribution was made.

(v) Transparency of Contributions 

Irish Heritage News reserves the right to:

Request the full name and contact details of the contributor;

Request from the contributor any other information that it considers to be necessary or desirable to determine the provenance of the contribution;

Undertake any further investigations it deems fit to determine the provenance of the contribution.

If the contributor refuses to provide any information as outlined above, Irish Heritage News may refuse and return the contribution to the contributor at its discretion.

(vi) Confidentiality and Publicity 

Contributors shall not be entitled to publicise their contribution or otherwise market themselves or any connected person or business in connection with their contribution, except with the prior written consent of Irish Heritage News and then only if the contributor complies with any relevant policies, procedures or requirements of Irish Heritage News.

(vii) Data Protection and Privacy 

Information about how we handle your personal data is set out separately in the Irish Heritage News Privacy Policy.

(viii) Exclusion of Liability 

Neither Irish Heritage News nor any affiliated person, owner, director, employee or officer shall be liable for any loss suffered by any donor or other person arising out of or in connection with a contribution, whether direct or indirect, including loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise.

(ix) Miscellaneous

A failure of Irish Heritage News to assert a right or provision under these Terms and Conditions shall not constitute a waiver of that right or provision.

This Agreement constitutes the entire agreement between the contributor and Irish Heritage News in respect of any contributions made by the contributor.

12. Disclaimer and Waiver

You acknowledge that your use of our website is at your own discretion and risk and you agree to waive to the fullest extent permissible by law any right to bring any claim or action against us, contractors, contributors, third-party advertisers, technology providers or other partners, for any loss, damage, costs or injury arising from such use.

We do not give any warranty or make any representation as to the accuracy or completeness of the information contained on our website or in printed material. We will strive to have any inaccuracies amended if possible but we make no commitment to update the information. We disclaim all liability and responsibility arising from any reliance placed on our content by any user or by anyone who may be informed of any of its contents.

We do not warrant that the website is free from infection by viruses or anything else that has contaminating or disruptive properties.

Under no circumstances shall we be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces or causes beyond our reasonable control, including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in electricity or other utility supply.

Under no conditions and in no event shall we be liable for any direct or indirect, incidental, consequential, special or exemplary damages or loss howsoever arising, or for any loss of data, profit, revenue, reputation, goodwill, other intangibles or business howsoever caused even if that loss or damage was foreseeable by us or the possibility of it was brought to our attention.

13. Termination and Availability of Service

Irish Heritage News may at any time terminate or suspend any part of our services without notice to you. You acknowledge and agree that we, at our sole discretion, may terminate your use of the website without prior notice, and remove and discard any user content, for any reason, with or without prior notice, including, without limitation, if we believe that you have violated or acted inconsistently with these Terms of Use or our Privacy Policy. You acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account. In the event that this should occur, you agree not to re-register on the website. You acknowledge that we reserve the right to take action – legal, technical or otherwise – to block or deny your ability to register or submit user content. You understand that we may exercise this right in our sole discretion. You agree that we shall not be liable to you or any third party for termination of your access to the website.

Our website may be temporarily unavailable from time to time for maintenance or other reasons. We accept no responsibility for any error, omission, interruption, deletion, defect, delay in transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of user communications. You agree that we shall not be liable to you or any third party for any inability to access our website, termination or suspension of access to our website or modification of the services provided.

You agree to indemnify, defend and hold harmless Irish Heritage News, its owners, consultants, contractors, authors, researchers, affiliates and technology providers, from any and all third-party claims, liability, judgments, fines, penalties, fees, expenses, losses, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your use of the Irish Heritage News website, products and services, your transmission or posting of user content, your unauthorized use of material obtained from the website, your breach of the Terms of Use, your infringement of any intellectual property right or any other right of any person or entity, your breach of any duty of confidence or privacy, your violation of any law, or any defamatory statements made by you in any form.

If any part of our Terms of Use is unenforceable, void or invalid (including any provision in which we exclude our liability to you), the remaining provisions will not be affected and will continue to be of full force. So far as possible where any clause/subclause or part of a clause/subclause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /subclause as is permitted by law.

16. Governing Law

Our Terms of Use shall be construed in accordance with the laws of the Republic of Ireland / Éire. All disputes and matters arising out of or in connection with our Terms of Use, shall be governed by the laws of the Republic of Ireland / Éire and are subject to the exclusive jurisdiction of the Irish courts.

17. Changes to Our Terms of Use

We may change, modify, add to or delete portions of these terms at any time. It is your responsibility to regularly review our terms (this page) for changes. By continuing to use our website or any of our services you will be deemed to have read, understood and agreed to be bound by these changes.

18. Entire Agreement / No Waiver

These Terms of Use and our Privacy Policy make up the entire agreement between you and us in relation to your use of our website, services and products, and supersede any prior agreement. The failure of Irish Heritage to exercise or enforce any portion of these Terms of Use shall not constitute a waiver or modification of any such right or position.
